Terms of Service

These Terms of Service ("Terms") are a contract between you and Autobyline ("we", "us", or "our") governing your access to and use of the Service at autobyline.io, app.autobyline.io, and related applications (the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Account Registration

• You must provide accurate, current information when registering.
• You are responsible for safeguarding your credentials and API keys.
• You must notify us promptly of any unauthorized use.
• One person or entity per account; account sharing is not permitted.

3. Subscription and Billing

3.1 Plans and credits

• Subscription plans are billed monthly or annually in advance. Pricing is published at autobyline.io/pricing.
• Each plan includes a credit allowance that resets at the start of each billing period. Unused subscription credits do not roll over.
• Credit Pack credits (one-time purchases) never expire.
• One article costs 3 credits; one image costs 15 credits.

3.2 Payment processing

Payments are processed by Polar.sh, which acts as our Merchant of Record. Polar.sh handles sales tax, VAT, and other applicable taxes for your jurisdiction. By subscribing, you also agree to Polar's terms.

3.3 Auto-renewal

Subscriptions renew automatically at the end of each billing period unless you cancel. You can cancel at any time from Settings → Payment, effective at the end of the current period. You retain access through the end of the period you paid for.

3.4 Price changes

We may change pricing for new subscriptions at any time. For active subscribers, we will provide at least 30 days' notice by email before any price change takes effect at the next renewal. You may cancel before the change takes effect.

4. Refund Policy

We offer a 60-day refund for first-time subscribers and Credit Pack purchases. If you are dissatisfied, email [email protected] within 60 days of your first charge for a full refund. Refunds for renewals are evaluated case by case at our discretion.

For EU/UK residents, statutory withdrawal rights apply where required by local law.

5. Acceptable Use

You agree NOT to use the Service to:

• Generate content that is illegal, defamatory, or violates the rights of others.
• Generate child sexual abuse material (CSAM), terrorism content, or content promoting violence.
• Generate spam, phishing content, or material designed to deceive.
• Impersonate any person or entity without authorization.
• Reverse-engineer, scrape, or attempt to extract our model weights, prompts, or training data.
• Resell or sublicense the Service without our written permission.
• Bypass rate limits, security features, or attempt to gain unauthorized access.
• Use the Service to violate applicable laws or regulations.

Violations may result in immediate suspension or termination without refund. We may cooperate with law enforcement when required.

6. Content Ownership

6.1 Your content

You retain all rights to prompts you submit and articles you generate. We claim no ownership over your inputs or outputs. By using the Service, you grant us a limited license to process your content for the sole purpose of providing the Service.

6.2 AI-generated content

AI-generated content is provided "as is". You are responsible for reviewing, editing, and fact-checking before publication. AI may produce inaccurate or misleading information; you bear full responsibility for any content you choose to publish.

6.3 Our content

The Autobyline name, logo, marketing copy, and source code are our intellectual property. Nothing in these Terms grants you a license to use them outside of using the Service.

7. Third-Party Services

The Service integrates with third-party platforms (WordPress, Polar.sh, Google, Anthropic, Perplexity, Runware, Cloudflare, Supabase, Resend). Your use of these services is governed by their respective terms. We are not responsible for third-party outages, policy changes, or fees.

8. Service Availability

We provide the Service on a commercially reasonable basis. We do not guarantee uninterrupted availability. Scheduled maintenance, third-party outages, and force majeure events may affect availability. No SLA is provided for current plans.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, OR FREE OF BIAS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REPUTATIONAL HARM.

Some jurisdictions do not allow these limitations; in such cases the limitations apply to the fullest extent permitted.

11. Indemnification

You agree to indemnify and hold us harmless from claims arising from: (a) your content and how you use it, (b) your violation of these Terms, (c) your violation of any law or third-party right, including intellectual property rights of third parties.

12. Termination

• You may cancel your subscription anytime from Settings → Payment.
• You may delete your account anytime via Settings → Account (or by email).
• We may suspend or terminate your account for violations of these Terms.
• On termination, your access ends and your data is deleted within 30 days (except where retention is legally required).

13. Modifications to These Terms

We may update these Terms from time to time. Material changes will be announced by email and on this page at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.

14. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Korea, without regard to conflict of law principles. Any dispute will be resolved in the competent courts of Seoul, Republic of Korea, except where mandatory consumer protection laws of your jurisdiction provide otherwise.

EU and UK consumers retain the right to bring claims in their home jurisdiction where local law requires it.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
